General conditions governing the activities of the online store Birdfreeder.com are constructed in accordance with the Consumer Protection Act (ZVPot), GZS recommendations and international codes for e-business.

Birdfreeder.com is an online store managed by the company Vivart d.o.o., Velnarjeva 7, 1000 Ljubljana, SloveniaSI13464035 a provider of e-business services, in the following referred to as the provider.


General conditions governing the activities of the online store Birdfreeder.com address user rights and business relationship between the provider and the customer.


Information availability

The provider is obliged to the customer to always provide the following information:


  • a. identity of the company (name and place of business, register number)
  • 
b. contact addresses, enabling quick and effective communication (e-mail, phone)
  • c. essential characteristics of goods or services (including after-sales services and guarantees)
  • 
d. availability of products (each product or service that is offered on the website should be available within a reasonable period)
  • 
e. terms of delivery of the product or service execution (method, place and date of delivery)
  • 
f. all prices must be clearly and unambiguously defined and it must be clear whether they contain taxes and transport costs 

  • g. method of payment and delivery

h. the validity of the offer

i. the period within which it is possible to withdraw from the contract and conditions for withdrawal, and furthermore if and how much it costs the buyer to return the product

Payment method


The provider at the online shop Birdfreeder.com enables the following payment methods:

  • preliminary invoice 
  • payment or credit card (Eurocard / Mastercard, Visa)
  • paypal


  • cash on delivery (only possible in Slovenia)

Purchase agreement (contract) is electronically stored on the server and customer service available 24 hours a day.

Prices


Prices are valid from the time the order was sent and do not have a predetermined force. 
Prices are valid in the case of payment with the above mentioned methods of payment under the above mentioned conditions. 
In the event that the price of the product changes during processing the order, the provider shall inform the customer about it. The provider will try to provide a lower price or offer an appropriate solution, which will enable mutual satisfaction.

Purchase procedure

1. Pending order

After placing the order, the buyer receives a notification by e-mail that the order was accepted in the queue. At this stage the buyer has the possibility to cancel the order within 1 hour. All of the information on the status and content of the order are always available to the buyer on the provider's website, under the heading "My Corner".

2. Confirmed order


Within two to 48 hours of getting the order, the provider reviews it, checks availability and confirms the order or refuses it with a reason. The provider reserves the right to call the customer, if necessary, on the given contact telephone number. At the time of the order confirmation, the provider informs the customer of the expected time of delivery by e-mail. The contract to purchase the ordered products between the customer and the provider is irrevocably concluded at this stage.

3. Dispatched goods


Within the promised deadline the provider packs the goods, dispatches them and informs the buyer by e-mail or phone. In the same email the provider also informs the buyer of goods return policy, how to proceed in the case of delay in delivery and in the event of complaint.

The right to withdraw from the purchase and the return of goods

The costumer is entitled to return the goods in fifteen (15) days after receiving them without any compensation. However, the buyer is obliged to bear the expenses incurred in returning the purchased item (any possible postage). The goods should be sent in appropriate packaging to: Vivart d.o.o., Velnarjeva 7, 1000 Ljubljana, Slovenia. Products must be unused, undamaged, in original and unopened packaging and with a valid expiration date. They must be accompanied by an original invoice with the name and quantity of returned goods and the transaction account of the sender (number and unit of the bank) for the payment of the purchase price. 

The provider returns the entire purchase price excluding postage costs within 15 days after receiving returned goods. 

The provider is not obliged to accept cash on delivery shipments or shipments that do not meet the provider's general conditions.

Delivery


The provider must deliver the goods or services in the promised time, which is indirectly dependent on the delivery performer. The delivery of packages is carried out by Delivery service, GLS Express Mail. Expected delivery time is stated in FAQ, sometimes due to special circumstances may be even longer. Protection of children

Advertisements must be clearly displayed (taking into account age) and must be clearly separated from games and competitions. 
Any communication intended for children must be suitable to their age and must not exploit the credibility of children, their lack of experience or sense of loyalty. 
The provider may not take orders from someone, knowing or suspecting that it is a child without specific permission from parents or guardians. 
The provider may not accept any personal data relating children without expressed permission from their parents or guardians. The provider may also not issue data taken from children to a third party, except to parents or guardians. 
The provider shall not offer free access to products or services that are harmful to children.

Absolution of responsibility

The provider shall in the best effort assure that the information published on the website is up-to-date and accurate. However, the characteristics of products, their availability and price change so rapidly that the provider fails to correct the information on the Internet. In this case the provider informs the customer of changes and enables them the cancellation of the contract or the replacement of the ordered product. 

The provider is not responsible for the content of views on items which visitors write. The provider checks the opinions before their publication and rejects those that contain obvious false, misleading or offensive information. The provider is not responsible for the information and opinions and is absolved of any liability arising from the information in the opinions. 

All photos of products are symbolic and do not provide the characteristics of the product.

Complaints and disputes


The provider respects the existing consumer protection laws. 

The provider is required to establish an efficient system of dealing with complaints. In the case of any problems the costumer can contact the provider by telephone or email. The procedure for submitting complaints is possible by e-mail hello@birdfreeder.com  or writing to the company. 

The provider will confirm the receiving of a complaint within five working days and explain the course of further procedures to the customer. 

The provider is aware that essential characteristic of consumer dispute, as far as the judicial resolution is concerned, is its disproportion between the economic value of the claim and costs incurred in resolving the dispute itself. This is also a major obstacle that prevents the consumer to initiate proceedings before the court. 
Therefore, the providers should do their best to resolve any disputes by mutual agreement.

When customers register with birdfreeder.com to place an order via the internet the following data is captured by Birdfreeder.com:

 

Customer ID – To uniquely identify a customer. Customer IDs are used by Garden Bird Supplies in all correspondence. These are allocated by Garden Bird Supplies to all new Customers.

 

Password – To ensure that access to sensitive information about a customer, and any associated orders placed, is secure. The password is set by the customer and remains unique to them.
Password Hint This is a phrase entered by the customer to assist them in remembering the password they set, e.g. "Mother's Maiden Name".

 

Name & Address – To ensure accurate delivery of all written correspondence to the customer. This is used in all contact with a customer regarding an order and to advise of any future product offerings.

 

Phone number – To be able to easily contact the customer in the event of any problems arising with orders. Periodically this may be used by birdfreeder.com to survey customers regarding quality of service.

 

Email Address – To be able to easily contact the customer in the event of any problems arising with orders. This may also be used to advise a customer of any special offers and product offerings.

 

For every order a customer enters the following data is also collected.

 

Payment Card Details Including card holder's name, card number, card start date (if applicable), card expiration date, card issue number (for debit cards only). These are used to accurately process the card payment and to deal with any queries which might arise.

 

Recipient Details Including name/title, address, phone number. These details are used to ensure accurate despatch of the order.
