Terms of service

These terms and conditions apply to all sales of products and services by Vivart d.o.o., Velnarjeva 7, 1000 Ljubljana, Slovenia, to costumers.

PAYMENT

The Website prices are strictly for use in all online transactions.Online customers must register to our website to submit the order. After registration the customer has access to several advantages and can participate in all marketing actions developed by Vivart d.o.o. Customers will also receive in their mailbox free informations about new products and events. Vivart d.o.o. compromises to use customers personal data according to high security standards, and assures to use them strictly to submit orders and to send all newsletters about new products. Vivart d.o.o. will occasionally use customers e-mail to notify website updates, new services and special offers. Upon registration on the website you can choose not to receive these information. All products you buy on the website shall be delivered to you by mail after confirmation of stock availability. The stock that is put on the website is only informational and not binding to Vivart d.o.o. When you buy products on the website which are available, the delivery system will be processed according to the client's selection. If you disrespect this policy rule Vivart d.o.o. will not deliver any package request.

WARRANTY

Costumer shall inspect all products immediately upon delivery and shall within 7 calendar days, give written notice to Vivart d.o.o. of defects or any claim for damages or shortages. Costumer shall give written notice to Vivart d.o.o. of hidden defects within 8 calendar days of delivery. If costumer fails to give any such notice the products shall be deemed accepted for all purposes of this agreement.

SHIPPMENT

The shipment is carried out after the payment of goods or services is made. In the event of Vivart d.o.o. being rendered temporarily unable by force majeure, industrial disturbances or temporarily inability to obtain products from Vivart d.o.o. to carry out its obligations it is agreed that the obligations of Vivart d.o.o. shall be suspended during the continuance of any inability so caused. In the event of Vivart d.o.o. inability to deliver products Vivart d.o.o. is exempted from all obligations if it has notified the costumer as soon as possible regarding the inability to deliver product and refunded any corresponding payments. Shippment is at costumers expense with the risk of loss or damage to pass to Customer upon delivery of Vivart d.o.o. to a carrier.

When customers register with birdfreeder.com to place an order via the internet the following data is captured by Garden Bird Supplies:

Customer ID – To uniquely identify a customer. Customer IDs are used by Garden Bird Supplies in all correspondence. These are allocated by Garden Bird Supplies to all new Customers.

Password – To ensure that access to sensitive information about a customer, and any associated orders placed, is secure. The password is set by the customer and remains unique to them.
Password Hint This is a phrase entered by the customer to assist them in remembering the password they set, e.g. "Mother's Maiden Name".

Name & Address – To ensure accurate delivery of all written correspondence to the customer. This is used in all contact with a customer regarding an order and to advise of any future product offerings.

Phone number – To be able to easily contact the customer in the event of any problems arising with orders. Periodically this may be used by birdfreeder.com to survey customers regarding quality of service.

Email Address – To be able to easily contact the customer in the event of any problems arising with orders. This may also be used to advise a customer of any special offers and product offerings.

For every order a customer enters the following data is also collected.

Payment Card Details Including card holder's name, card number, card start date (if applicable), card expiration date, card issue number (for debit cards only). These are used to accurately process the card payment and to deal with any queries which might arise.

Recipient Details Including name/title, address, phone number. These details are used to ensure accurate despatch of the order.
